World Surgery Tour's Terms and Conditions

1. Scope

The following General Terms and Conditions apply to the purchase of tickets via our website https://www.worldsurgerytour.com/ - hereinafter also referred to as "Online Platform" for the World Surgery Tour. Our offer is aimed at consumers and entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her commercial or self-employed professional activity.

2. Contracting party, conclusion of contract, correction options

The contractual partner is Rimasys GmbH, Nattermannalle 1, 50829 Cologne - hereinafter referred to as "Rimasys".

The presentation of the offers on the online platform, in the online shop, and via the platform does not constitute a legally binding offer, but a non-binding online catalog.

For the worldsurgerytour, you can buy tickets to visit the site, attend courses, and tickets to participate online.

You can initially place your order in the shopping basket without obligation and correct your entries at any time before submitting your binding order or booking by using the correction aids provided and explained for this purpose in the order process. By clicking on the order button you place a binding order or booking. Rimasys declare acceptance of the customer's offer by sending an order confirmation, which also contains the necessary information for the use of the event and/or services of Rimasys and Trauma Academy selected by you.

Participation in the World Surgery Tour is free to everybody but only healthcare professionals are admitted to participate in hands-on courses.

3. Contract language, contract text storage

The languages available for the conclusion of the contract are German and English.

4. Registration when participating in an online event

To view online events, you must have a working internet connection and an up-to-date browser. Rimasys reserves the right to change the technical requirements for the use of the platform and the services.

In order to access the online event the customer has to create an account on World Surgery Tour TV. By using name, surname, e-Mail an choosing a password.

Upon completion of the registration, a user relationship with Rimasys is created, which enables the customer to participate in the online event. Access is granted upon payment if the payment is required, otherwise without payment.

5. Payment

The following payment methods are generally available to you:

Credit card

When you place your order, you provide your credit card details. Your card will be charged immediately after you place your order.

PayPal

In order to pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, legitimize yourself with your access data and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order is placed. You will receive further instructions in the order process.

In case you are unable to attend the Festival you can apply for a refund until 18. February 2024. Rimasys is entitled to deduct a refund fee of 150 EUR from the ticket price. Tickets for mere online-participation are not refundable.

6. Right of withdrawal

If you buy a ticket for a participation in presence, you do not have the right of withdrawal according to § 312g para. 2 no. 9 BGB (German Civil Code).

If you purchase a ticket for online participation, you have a right of cancellation in accordance with the following provisions.

§ 6 Cancellation policy

If you are a consumer, you have a statutory right of withdrawal.

(1) Cancellation policy: Consumers generally have a fourteen-day right of cancellation.

(2) Right of withdrawal: You have the right to withdraw from this contract within fourteen days without giving any reason. The revocation period is fourteen from the conclusion of the contract (§ 4).

To exercise your right of withdrawal, you must inform us via e-Mail

(e-mail-address: contact@worldsurgerytour.com) of your decision to withdraw from this contract by means of a clear declaration. You can use the enclosed model withdrawal form for this purpose, which is, however, not mandatory.

To comply with the cancellation period, it is sufficient for you to send the notification of the exercise of the right of cancellation before the end of the cancellation period.

(3) Consequences of revocation: If you revoke this contract, we must return to you all payments that we have received from you immediately and at the latest within fourteen days of the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.

7. Expiry of the right of withdrawal after execution of the contract

The subject of the contract is the provision of online access. Pursuant to Section 356 (5) of the German Civil Code (BGB), your right of cancellation therefore expires if we have commenced performance of the contract with your consent prior to the expiry of the cancellation period and (cumulatively) have informed you that you lose your right of cancellation upon commencement of performance and you have confirmed this. Consumers are entitled to the statutory right of cancellation as described in the cancellation policy. Entrepreneurs are not granted a voluntary right of withdrawal.

8. Termination, deletion of the customer account

The contractual relationship can be terminated by the customer at any time. All that is required is an e-mail to info@rimasys.com expressing the wish to remove the customer account.

After receipt of the e-mail, the customer account will be completely deleted after 30 days

9. Liability

For claims based on damage caused by us, our legal representatives or vicarious agents, we shall always be liable without limitation:

in the event of injury to life, limb, or health,
in the event of intentional or grossly negligent breach of duty,
in the case of guarantee promises, insofar as agreed, or
insofar as the scope of application of the Product Liability Act is opened.
In the event of a breach of material contractual obligations, the fulfillment of which is a prerequisite for the proper performance of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives or vicarious agents, the amount of liability shall be limited to the damage foreseeable at the time of the conclusion of the contract, the occurrence of which must typically be expected.
Otherwise, claims for damages are excluded.

10. Rights of use

All content on the Website as well as all content which is an element of the world surgery tour, including but not limited to text, graphics, logos, images, videos, audio clips, software, and other materials, is the intellectual property of Rimasys GmbH or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not modify, reproduce, distribute, display, or use any content from the Site without our prior written consent.

11. Taking photos and videos/rights of use

We point out that there will be filming and photography activities – hereinafter names as “materials” - taking place during your participation in Presence on the World Surgery Tour.

Rimasys GmbH and its affiliates are entitled to edit, modify, reproduce, publish, and distribute these materials, including but not limited to photographs, videos, and audio recordings in various media, including but not limited to print, digital, online, social media and broadcast channels for our promotional, marketing, and advertising purposes, without any compensation or royalties payable to you.

The materials may be used in a wide range of promotional materials, such as brochures, websites, advertisements, social media posts, press releases, and presentations of Rimasys and its affiliates.

Rimasys GmbH shall have the sole discretion to determine the manner, timing, and extent of the use of these materials.

12. Dispute resolution

The European Commission provides a platform for online dispute resolution (OS), which you can find here. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.

13. Final provisions

If you are an entrepreneur, German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

If you are a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you shall be our registered office.
